General terms and conditions

1. Definitions

In these general terms and conditions the following terms shall have the following meanings:

Cooling-off period: period within which the consumer can make use of his right of withdrawal.

Consumer: a natural person, not acting in the exercise of a profession or business and who enters into a distance contract with Accido.

Date: 19-04-2020

Right of withdrawal: the consumer’s right to cancel the distance contract within the specified cooling-off period.

Accido: the company that offers products to consumers remotely.

Distance contract: contract between consumer and Accido, concluded remotely using a system intended for that purpose.

Written: written also includes electronic communication, such as e-mail, provided that the identity of the sender and the authenticity of the communication are sufficiently established.

2. General

These general terms and conditions apply to every offer from Accido and to every distance contract concluded between Accido and the consumer.

The agreement is concluded at the moment that the consumer accepts the offer from Accido and complies with the conditions set out in that offer.

Accido will confirm receipt of acceptance of the offer without delay. Until Accido has sent this confirmation, the consumer can terminate the agreement.

Accido has the right to ask me by email for my opinion of the products in the form of a review.

Promotions and Discounts:
Promotions and discounts on our webshop are subject to the following conditions:

1. Bulk packages are excluded from all promotions and discounts.

2. Discounts cannot be combined with other discounts, offers or promotions, unless otherwise stated.

3. Promotions and discounts are only valid on regular quantities for private use.

4. Changes in price, model and availability are reserved at all times.

5. Errors and typographical errors reserved.

By using promotions and discounts on our webshop, you accept these conditions.

3. Right of withdrawal

The consumer has the right to terminate the agreement without giving any reason within 14 days after receipt of the product by the consumer or a representative designated in advance by the consumer or a delivery location chosen by the consumer.

Consumer will handle product and packaging with care during this period. Consumer will only unpack or use the product to the extent necessary to assess the product.

Food items can only be exchanged if the packaging is unopened.

If the consumer wishes to exercise the right of withdrawal, he must report this in writing to Accido within the cooling-off period. Accido will immediately send a confirmation of this message.

Products must be returned to Accido together with all accessories supplied and as much as possible in the original condition and packaging, in accordance with the clear and reasonable instructions provided by Accido. In any case, a copy of the packing slip must be enclosed.

In case of cancellation, the costs of return shipment will be borne by the consumer.

After cancellation, the consumer must return the product within 14 days in accordance with the provisions of paragraph 4.

Accido will reimburse payments received from the consumer within fourteen days of termination.

4. Exclusion of the Right of Withdrawal

The right of withdrawal is generally excluded for the following products: which have been created by Accido in accordance with the consumer’s specifications;
which are clearly personal in nature;

which by their nature cannot be returned;

that can spoil or become outdated quickly;

the price of which is subject to fluctuations in the financial market over which Accido has no influence;

5. Delivery

The place of delivery is the address that the consumer has made known to Accido.

Orders completed before 12:00 will in principle be delivered within two days. Accido will deliver orders within 30 days at the latest, unless a longer delivery period has been agreed. Accido will report delays in delivery in a timely manner.

The consumer has the right to dissolve if delivery only takes place after these 30 days or can take place without this having been agreed in advance. In the event of dissolution, Accido will reimburse the payments received from the consumer within thirty days at the latest.

The risk of damage or loss of products is transferred to the consumer at the time of delivery to the consumer or a third party designated by them in advance.

6. Warranties and Conformity

Accido does not offer any (additional) guarantees with regard to delivered products.

Consumers must store and use the products in accordance with the storage advice of Accido.

Products must meet the reasonable expectations of consumers.

If a defect turns out to be a fault existing at the time of purchase, the consumer is entitled to replacement of the product. Only when the product is no longer produced or replacement would unreasonably exceed the value of the product, may Accido offer to reimburse the purchase price to the consumer.

Compensation, repair or replacement due to a defect in a product will lapse if the defect arose as a result of or arises from careless, injudicious or improper use thereof or use after the expiration date, incorrect storage or maintenance by the consumer.

7. Complaints and Disputes

Agreements between Accido and consumers are exclusively governed by Polish laws.

Complaints about the performance of the agreement must be reported to Accido in writing, fully and clearly described, within a reasonable time, but no later than 14 days after the consumer has discovered the defects.

Complaints submitted to Accido will be answered within 14 days of receipt of the complaint. If the complaint cannot be resolved within 14 days, Accido will report this in a timely manner and provide an indication of the period within which the consumer may expect a solution.
